The system will look a little different and some terminology has changed – for example, instead of completing Annual Certifications, researchers will now be asked to update your Disclosure Profile annually. The COI training required every other year has been streamlined along with other actions of the disclosure process to make it easier to complete.<br><br></li><li style="margin-left:15px"> A new version of the Financial Conflict of Interest (FCOI) Guidelines will be available on our [ORIC, see below] website on June 5, 2023. This document has been restructured to include more information about differences in agency-specific COI policies, but there are no substantive differences to the content of the FCOI requirements.<br><br></li><li style="margin-left:15px">A new process and Guidelines have been developed for disclosure of Outside Activities within SPARCS COI. The OA Guidelines, which will also be available on our [ORIC, see below] website on June 5, 2023 provide more detail, but broadly, this means researchers will now be required to disclose new types of activities and relationships that were not previously required, including, for example, unpaid activities, outside appointments, token payments such as honoraria that don’t rise to the level of requiring an FCOI disclosure, and gifts or in-kind contributions. OAs only need to be disclosed if they are related to a researcher's professional, scientific, research, or academic expertise. OAs will be disclosed at the same time as FCOI disclosures in a single disclosure process.<br><br></li><li style="margin-left:15px">Researchers with potential conflicts of interest, and staff who act as conflict of interest management plan monitors, will see some streamlining and updates to those processes.</li></ol><p style="margin:0in;font-family:Calibri,sans-serif"><b style="font-family:Arial,Helvetica,sans-serif"><i>What do researchers/investigators need to do as a result of these changes?</i></b><br style="font-family:Arial,Helvetica,sans-serif"><br style="font-family:Arial,Helvetica,sans-serif"><span style="font-family:Arial,Helvetica,sans-serif">Nothing immediately. These changes are being implemented in the SPARCS COI system on Monday, June 5, 2023. However, researchers will not be impacted until the next time they are required to update their Disclosure Profile in SPARCS.</span><br style="font-family:Arial,Helvetica,sans-serif"><br style="font-family:Arial,Helvetica,sans-serif"><span style="font-family:Arial,Helvetica,sans-serif">Expiration dates for your current Annual Certification and your current COI training, along with all disclosure data, will be transferred during the upgrade. If researchers are currently overdue to disclose or complete training they will receive a one-time reminder when the new system comes online on June 5, 2023, and then will return to receiving reminders at the same intervals they already receive them (monthly, for most types of overdue notifications.)</span><br style="font-family:Arial,Helvetica,sans-serif"><br style="font-family:Arial,Helvetica,sans-serif"><span style="font-family:Arial,Helvetica,sans-serif">Researchers will be required to review and update their Disclosure Profile at the time of their next proposal submission or their next Disclosure Profile expiration date, whichever comes first. In addition, ORIC staff may reach out to research personnel as they receive new grants in the coming months to ensure their disclosures are up to date.</span><br style="font-family:Arial,Helvetica,sans-serif"><br style="font-family:Arial,Helvetica,sans-serif"><b style="font-family:Arial,Helvetica,sans-serif"><i>Why are these changes being made?</i></b><br style="font-family:Arial,Helvetica,sans-serif"><br style="font-family:Arial,Helvetica,sans-serif"><span style="font-family:Arial,Helvetica,sans-serif">These updates are being driven by changing federal regulations and increased federal scrutiny regarding accurate reporting of outside interests, as well as recommendations made by the President’s Committee on International Engagements. Specific regulatory changes and/or communications from agencies that are motivating these changes include:</span><br style="font-family:Arial,Helvetica,sans-serif"></p><ul style="font-family:Arial,Helvetica,sans-serif"><li style="margin-left:15px">NIH’s updated disclosure requirements related to the biosketch and other support (see NOT-OD-21-073) became effective January 25, 2022. These changes expand what must be reported as “other support.”<br><br></li><li style="margin-left:15px">NSF’s changes to current and pending support were updated on January 30, 2023. These changes expand what must be reported as “other support.”<br><br></li><li style="margin-left:15px">The National Science and Technology Council has released guidance to agencies on implementing the White House’s National Security Presidential Memorandum-33 (NSPM-33). In following this guidance, many federal agencies are expected to enact future policy and process changes that will generally lead to a greater number of participants in federally funded projects having to disclose a larger number of activities in their COI and/or current/pending/other support requirements.<br><br></li><li style="margin-left:15px">NASA released a draft conflict of interest and conflict of commitment policy for public comment in January 2023.</li></ul><p style="margin:0in;font-family:Calibri,sans-serif"><span style="font-family:Arial,Helvetica,sans-serif">The changes being made to the SPARCS COI process and system will support compliance with these current and anticipated changes in federal requirements.
